Agreement to Terms

By accessing or using YOKED AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

1. Use of Service

1.1 Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

1.2 Account Responsibility

• You are responsible for maintaining the confidentiality of your account
• You agree to provide accurate, current information
• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access

1.3 Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Reverse engineer, decompile, or disassemble the app
• Upload malicious code or viruses
• Harass, abuse, or harm other users
• Share your account with others
• Use automated systems (bots) without permission

2. Subscriptions and Billing

2.1 Free and Paid Plans

YOKED AI offers a free tier with limited features and a premium subscription ("YOKED AI Pro") with full access.

2.2 Pricing

• Monthly Plan: $9.99/month
• Annual Plan: $79.99/year (save 33%)
• Prices are subject to change with 30 days notice

2.3 Payment Processing

Payments are processed through Apple App Store or Google Play Store. Billing is handled by their respective payment systems.

2.4 Free Trial

• New users may receive a 7-day free trial
• You will not be charged during the trial period
• Cancel anytime before the trial ends to avoid charges
• Trial is available once per user

2.5 Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can cancel anytime through your app store account settings.

2.6 Refunds

Refund requests are handled by Apple/Google according to their policies. Generally, we offer refunds within 14 days of purchase if you haven't extensively used the Service.

3. Intellectual Property

3.1 Our Content

The Service, including its software, design, text, graphics, and content, is owned by YOKED AI and protected by copyright, trademark, and other intellectual property laws.

3.2 Your Content

• You retain ownership of content you create (workout logs, posts, etc.)
• You grant us a license to use your content to provide and improve the Service
• For public posts, you grant us a license to display them within the app
• We may use aggregated, anonymized data for analytics and research

3.3 Exercise Videos

Exercise demonstration videos are licensed from third parties or created by us. You may not download, redistribute, or use them outside the app.

• Consult a physician before using the Service, especially if you have pre-existing conditions
• Exercise at your own risk and within your physical capabilities
• Stop immediately if you feel pain, dizziness, or discomfort
• We provide information, not medical advice
• You assume all risks associated with physical activity

6. Disclaimers and Limitation of Liability

6.1 Service Provided "As Is"

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

6.2 No Guarantees

We do not guarantee:

• Uninterrupted or error-free service
• Specific fitness results
• Accuracy of AI recommendations
• Accuracy of third-party nutrition data

6.3 Limitation of Liability

To the maximum extent permitted by law, YOKED AI shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business
• Personal injury or property damage
• Total liability exceeding the amount you paid in the last 12 months

7. Indemnification

You agree to indemnify and hold harmless YOKED AI from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

8. Termination

8.1 By You

You may delete your account at any time through the app settings. Subscription charges will continue until you cancel through your app store.

8.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse or harass other users
• Create multiple accounts to abuse free trials

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use after changes indicates acceptance.

10. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, please contact us at support@getyoked.ai to resolve the issue informally.

11.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration under the American Arbitration Association rules. You waive your right to a jury trial or class action.

12. Miscellaneous

• Severability: If any provision is found invalid, the remaining provisions remain in effect
• No Waiver: Failure to enforce a right does not waive that right
• Assignment: You may not transfer your account; we may assign our rights
• Entire Agreement: These Terms constitute the entire agreement between you and YOKED AI
